Spain's Rajoy says he was wrong to trust treasurer in party funding scandal

MADRID (Reuters) - Spanish Prime Minister Mariano Rajoy apologized on Thursday for mishandling a major corruption scandal, but denied he or his center-right People's Party accepted illegal payments and rejected opposition calls to step down.

It was the first time Rajoy had admitted any error since it emerged in January that the ruling party's former treasurer Luis Barcenas - in jail pending trial on charges of bribery and tax evasion - hid up to 48 million euros in Swiss bank accounts.

"I was wrong. I'm sorry but that is how it was. I was wrong in trusting someone we now know didn't deserve it," Rajoy told parliament at the start of a 5-1/2-hour special debate on the funding scandal that was carried live on television.

In a defiant one-hour speech and two shorter rounds of debate, he made no other admission of wrongdoing.

But he acknowledged the scandal has damaged Spain's image abroad at a time when his government is wrestling with a shrinking economy, 26 percent unemployment and a big budget gap.

Investors have shrugged off the scandal as it has not destabilized the government and on Thursday Spain sold debt more cheaply than two weeks ago. A European Central Bank back-stop for ailing euro zone countries has held Spain's borrowing costs at a reasonable level after they jumped last year and ignited fears of an international bailout.

Barcenas, who left his post in 2009 but continued receiving financial support from the party, told a judge he collected millions in cash donations from construction magnates and distributed them to senior PP figures, including Rajoy.

The Spanish leader has been criticized for maintaining contact with Barcenas up until recently. In January the prime minister sent the former treasurer an SMS text message that read: "Luis. I understand. Be strong. I'll call you tomorrow."

During the debate, opposition leaders from the Socialist and other parties repeated demands that Rajoy quit.

"Any other leader of a serious democracy in Europe would have stepped down over the SMS messages that you found perfectly acceptable. Can you imagine (German Chancellor Angela) Merkel texting a tax evader to tell him to 'be strong,?" asked Socialist leader Alfredo Perez Rubalcaba.

However, Rajoy said he would stay in office and continue with economic measures which have included spending cuts, tax hikes and rules to make hiring and firing less costly, policies welcomed by investors and Spain's European partners.

For months Rajoy had avoided any detailed statement on the Barcenas scandal. But as public pressure for accountability has grown and opposition parties threatened to call a vote of no confidence, Rajoy agreed to testify before lawmakers.

TAXES PAID

Rajoy said he had always declared all his income to tax authorities and said a judicial investigation would prove that there was no illegal financing in the party.

Barcenas, who worked 30 years for the PP, has testified that he maintained for almost two decades a set of shadow accounts tracking a slush fund of cash donations and payments that were hidden from tax authorities and auditors.

Rajoy dismissed the allegations as "a surprising and imaginative collection of lies" and said his party would be vindicated by the official investigation.

He said party members received payments beyond their salaries, for expenses and for seniority premiums, but said all those items were officially registered and that it was up to each individual to declare them in tax statements.

"The judge will determine how to proceed with each insinuation but I can tell you now that there was no shadow accounting and no crime was covered up," he said.

The scandal has damaged Rajoy's credibility and eroded voter support for the PP. But with the prime minister expected to hold on to power due to his party's strong majority in parliament, investors have barely reacted.

"There was some market concern about a month ago that Rajoy would be forced to resign but since then he's said he would carry out the full term, so no one's really paying attention to it," said Bhavisha Patel, strategist at consultancy 4Cast.

Opinion polls show politicians and political parties are widely mistrusted and the Socialists and the PP have lost significant ground to smaller parties which are perceived to be more honest.

Police: Explosion on FedEx in San Francisco, California, caused by package containing fireworks - @KTVU

San Francisco police and firefighters responded to a report of an explosion involving a FedEx truck in the city's South of Market neighborhood Wednesday afternoon but didn't find any damage.

There was also no one injured in the incident, which was reported at 2:01 p.m. near Sixth and Tehama streets, fire department spokeswoman Mindy Talmadge said.

Police spokeswoman Officer Tracy Turner said the FedEx driver called 911 to report an explosion.

When officers arrived, however, they could not find any sign that an explosion had occurred, Turner said.

A bomb squad responded and Tehama and Sixth streets were shut down, but the streets reopened about an hour later.

The FedEx truck appeared to be intact, and the driver declined to speak with reporters at the scene.

Turner said it is possible that someone threw a firecracker in the area of the truck.

Michael McKinney, a security guard who works on that block of Tehama Street, said there was a similar incident on Monday involving a report of an explosion with no damage.

He said he heard a loud bang that day, and wondered if someone had thrown some sort of explosive object from a window.?

Talmadge said initial reports indicated that the explosion might have been caused by a package in the truck containing fireworks, but Turner said police determined that was not the case.

Cleveland kidnapper's abuse aired at sentencing

CLEVELAND (AP) ? Three months after an Ohio woman kicked out part of a door to end nearly a decade of captivity, a former school bus driver who kidnapped three women and subjected them to years of sexual and physical abuse was being sentenced Thursday.

Prosecutors began detailing Ariel Castro's daily assaults on the women, recounted in diaries that compared the women's experience to that of prisoners of war. With the possibility of the death penalty for a forced miscarriage taken off the table, Castro stands to get life in prison plus 1,000 years.

Early in the hearing, Castro tried to apologize to the victims, but after speaking with the judge said he would do that later in the proceeding.

A police officer who helped rescue the women said one was reluctant to come out of her room even when she saw the officers. They were scared even after they were taken out of the house and quickly began sharing details about the horrors they went through, saying that they had been starved and beaten.

"They were just shouting out a lot of things," said Cleveland police officer Barb Johnson. She described the women as thin, pale and scared.

Responding to questions from prosecutors, Cleveland police detective Andrew Harasimchuk said that the women all described a pattern of being physically, sexually and emotionally assaulted for years. He said all three women were abducted after Castro offered them a ride and that each was chained in his basement and sexually assaulted within a few hours of being kidnapped.

Cuyahoga County prosecutor Tim McGinty said in a sentencing memorandum filed Wednesday that Castro, who chained his captives and fed them only one meal a day, "admits his disgusting and inhuman conduct" but "remains remorseless for his actions."

The memorandum says many of the specific charges in Castro's indictment reflect conduct documented by one of the women in her diary.

"The entries speak of forced sexual conduct, of being locked in a dark room, of anticipating the next session of abuse, of the dreams of someday escaping and being reunited with family, of being chained to a wall, of being held like a prisoner of war ... of being treated like an animal," it says.

The sentencing could take up to four hours, court officials said, with Castro, his attorneys, his victims and prosecutors getting a chance to speak. The legal team representing the women's interests declined to comment on whether they would testify or send statements to the court.

Prosecutors brought a model of the house where Castro, 53, imprisoned the women into the courtroom Thursday ahead of the sentencing.

In the court filing, McGinty said Castro chained his captives by their ankles, fed them only one meal a day and provided plastic toilets in their bedrooms that were infrequently emptied, the filing said. At one point, he locked all of them in a vehicle in his garage for three days while he had a visitor, according to McGinty's filing.

The women quickly escaped after Amanda Berry kicked out the door panel on May 6 and Castro was arrested within hours. The women disappeared separately between 2002 and 2004, when they were 14, 16 and 20 years old.

Other horrific details of the women's ordeal had already emerged, including tales of being chained to poles in the basement or a bedroom heater or inside a van, with one woman forced to wear a motorcycle helmet while chained in the basement and, after she tried to escape, having a vacuum cord wrapped around her neck.

Castro repeatedly starved and beat one of the victims each time she was pregnant, forcing her to miscarry five times.

He forced the same woman on threat of death to safely deliver the child he fathered with another victim on Christmas Day 2006. The same day, prosecutors say, Castro raped the woman who helped deliver his daughter.

Prosecutors will ask the judge to prohibit Castro from ever seeing his daughter, now 6.

As part of his plea deal, Castro received a sentence of life with no chance of parole for aggravated murder in the forced miscarriage. He then received 1,000 years for the kidnapping, rape, assault and other charges.

Berry, 27, made a surprise onstage appearance at a rap concert last weekend, and a second victim, Gina DeJesus, 23, has made a few televised comments. Knight, 32, appeared with Berry and DeJesus in a video in early July thanking the community for its support.

Knight, the first of three to disappear, also sent police a handwritten letter thanking them for their help collecting cards and gifts for the women. In the note, Knight told Second District Cmdr. Keith Sulzer, "Life is tough, but I'm tougher!"

Right-wing media have baselessly smeared the White House's new Behavioral Insights Team, labeling it "propaganda," "mind control," and "Orwellian." In reality, the Behavioral Insights Team is modeled off a similar unit in Britain that has proven effective in?encouraging timely tax payment?and reducing energy bills and consumption.

Conservative media seized on White House plans to create a Behavioral Insights Team on July 30, when FoxNews.com?obtained a document?describing the program and its search for behavioral scientists.

Breitbart.com quickly jumped on the story,?suggesting?that the Obama administration will use the program to push?a?social agenda:? "The Obama administration has not been shy about attempting to use its influence - or taxpayer money - to push enthusiasm for its agenda, including Obamacare, nutrition, and gay rights."

Fox stoked fears by hyping the program on multiple shows with little mention of its benefits. On?the July 30 edition of?Lou Dobbs Tonight,?Fox Business host Lou Dobbs?commented?on FoxNews.com's report on?the program, saying, "To many, that sounds purely like propaganda and mind control."

On July 31,?Fox & Friends?co-hosts Steve Doocy and Brian Kilmeade?implied?that the Behavioral Insights?Team, described onscreen as?the?"Nudge Squad," would lead to government coercion of citizens:

KILMEADE:?Right.?Nudge, push, shove, poke, we don't know. Here's the thing?--

America Live?host Shannon Bream later?described?the program as "raising serious concerns about Big Brother," and?Fox?News contributor Monica Crowley?fear mongered?that the program "has an Orwellian ring to it."

Contrary to right-wing media claims, the goals of the Behavioral Insights Team are far from?"mind control."?Rather, the?program?is modeled off its British counterpart, which has?utilized behavioral psychology?to target?fraud, error, and debt, and to reduce energy costs and consumption.

The document cited by Fox News?states?that using behavioral insights to inform policy can "help design?public?policies that work better, cost less, and help people to achieve their goals," and cites?the British Behavioural Insights Team commissioned under David Cameron as a money-saving model:

A growing body of evidence suggests that insights from the social and behavioral sciences can be used to help design public policies that work better, cost less, and help people to achieve their goals. The practice of using behavioral insights to inform policy has seen success overseas. In 2010, UK Prime Minister David Cameron commissioned the Behavioural Insights Team, which through a process of rapid, iterative experimentation ("Test, Learn, Adapt"), has successfully identified and tested interventions that will further advance priorities of the British government, while saving the government at least ?1 billion within the next five years (see previous Annual Reports 2010-11 and 2011-12).

The British Behavioural Insights Team found through experimentation that utilizing behavioral insights to shape policy is highly effective.?The Guardian?wrote?of the approach: "It is politics done like science, effectively?...?and, in many cases, it appears to work."

Subtle psychological "nudges" are particularly effective in encouraging people to pay their taxes on time.?Writing in?The New York Times, economist Richard Thaler?described?the program's income tax experiment, which found that changing the wording of late tax reminder letters?increased repayment rates by fifteen percent:

Letters using various messages were sent to 140,000 taxpayers in a randomized trial. As the theory predicted, referring to the social norm of a particular area (perhaps, "9 out of 10 people in Exeter pay their taxes on time") gave the best results: a 15-percentage-point increase in the number of people who paid before the six-week deadline, compared with results from the old-style letter, which was used as a control condition.

The?British?tax authorities estimate that this initiative, if rolled out across the country, could generate ?30 million of extra revenue annually, according to Thaler. Another trial that sought to reduce energy waste was?similarly effective, offering individuals subsidized loft clearance to encourage them to insulate their homes and reduce their energy bills and consumption.

LONDON (AP) ? Author JK Rowling has accepted a charitable donation from a law firm which revealed she wrote a crime novel under a pseudonym.

The Harry Potter author says her crime-writing alter ego, Robert Galbraith, had respectable sales before being exposed in the Sunday Times as a pseudonym. Though there had been speculation she had leaked the news to bolster sales, the law firm Russells acknowledged one if its partners had let the information slip to his wife's best friend, who tweeted it to a Sunday Times columnist.

Rowling sued the law firm partner. Her attorney, Jenny Afia, told Britain's High Court on Wednesday that Rowling was "distressed by such a fundamental betrayal of trust."

The firm agreed to reimburse Rowling's legal costs and to make a payment to the Soldiers' Charity.

Barclays seeks $9 billion from shareholders to appease regulator

LONDON (Reuters) - Barclays plans to raise 5.8 billion pounds ($8.9 billion) from its shareholders to address calls from Britain's financial regulator for the 320-year-old bank to strengthen its capital reserves against potential market shocks.

The Bank of England's Prudential Regulation Authority (PRA) said on Tuesday Barclays needed an extra 12.8 billion pounds ($19.7 billion) of capital, more than it estimated last month, and that it should fill the shortfall in the next year.

Barclays announced the fundraising alongside news that it would take another 2 billion pounds charge for mis-selling products and said it was also pushing back its target to deliver a key profitability goal.

Banks across Europe are battling to meet tougher regulations aimed at preventing a repeat of the financial crisis, and many are also struggling to move on from past misdeeds. Deutsche Bank , for example, missed second-quarter profit forecasts on Tuesday, hit by higher legal costs.

Barclays chief executive Antony Jenkins said he was reacting "quickly and decisively" to the PRA and that it was happy with his plan, which also includes selling 2 billion pounds of bonds that convert into equity or are wiped out if the bank hits trouble, and shrinking loans a further 65-80 billion pounds.

"I think they've done the right thing. Anything else would have been a fudge, they needed to get on and raise equity," said Mike Trippitt, analyst at Numis Securities. He said earlier this month Barclays could need 6-12 billion pounds of capital, which did not include the extra mis-selling provision.

However, investors said Barclays' move could dent the British government's plans to start selling its shares in Lloyds Banking Group later this year, by sucking up market demand for bank stock.

The rights issue will offer shareholders one new share for every four owned at 185 pence, in an offer that allows existing shareholders to buy discounted shares first to give them a chance to maintain their stake.

At 0830 GMT, Barclays shares were down 4.6 percent at 294.8 pence, the weakest performance in the European bank index <.sx7p>.

Regulators in Britain, Switzerland, the United States and elsewhere have been increasing scrutiny on leverage ratios, which do not rely on banks' own risk assessments but express a bank's capital as a proportion of its overall assets.

Barclays said the PRA had estimated its leverage ratio at 2.2 percent at the end of June, lower than the 2.5 percent it had estimated last month.

"As a consequence of the PRA's review we have had to modify our capital plans, in order to meet the 3 percent leverage ratio target by June 2014," Jenkins said, referring to a key PRA goal.

MIS-SELLING PAIN

Barclays said it was pushing back its target to deliver a return on equity above its cost of equity - previously 11.5 percent - to 2016, a year later than Jenkins set out in a far-reaching restructuring unveiled in February.

But it bumped up its dividend payout expectations, saying it expected to distribute 40-50 percent of earnings in 2014 compared with the 30 percent previously predicted.

Barclays set aside another 1.35 billion pounds in its first-half results to compensate customers for mis-sold payment protection insurance (PPI), taking its total provision for that to 4 billion pounds.

British banks have now set aside more than 15 billion pounds to cover PPI compensation, and Barclays' latest move signals rivals may also have to bump up their provisions.

Barclays also set aside a further 650 million pounds for the mis-selling of complex interest rate hedging products to small firms.

The bank reported a pretax profit of 1.7 billion pounds for the six months ended June, almost double its 871 million pound profit a year ago. Its adjusted pretax profit was 3.6 billion pounds, just below the average forecast of 3.7 billion pounds from 22 analysts polled by the company.

It said it was "cautious" on the outlook and operating environment and that it would accelerate its plan to cut costs. Jenkins' restructuring plan absorbed 640 million pounds of costs in the first half.

Barclays will pay about 130 million pounds in fees and commission on the rights issue. It will be launched in September, and new shares are expected to be issued on October 3, or possibly November 7. The shares have been priced at a 40 percent discount to Monday's closing price.

NBA: Fast success hasn?t changed Damian Lillard?s goals

NBA ? Reigning Rookie of the Year Damian Lillard sets his sights on Team USA spot.

After he arrived in Las Vegas for a Team USA minicamp, a handful of people close to Damian Lillard received a text message and picture from the Portland Trail Blazers point guard and reigning NBA Rookie of the Year.

"It was like, ?Man can you believe I have on this Team USA uniform?? " said Raymond Young, who coached Lillard with the AAU Oakland (Calif.) Rebels before he spent four years at Weber State.

The novelty of a small-school player becoming an instant NBA star continues to follow Lillard, despite his play last season freeing him from the shackles of misappropriated expectations. Reporters still ask about his "meteoric" rise and about being regularly overlooked.

One person who remains relatively unimpressed is Lillard himself. However, even he admitted last week that the rapid success he?s enjoyed has made him look at his dreams differently.

"I?ve always had big goals for myself," he said following a practice at the Mendenhall Center at UNLV, "but I think the fact that things actually started to happen with Rookie of the Year, and playing a lot of minutes, some of the records that I had, everything began to seem a little more possible, a little more real."

Lillard has never been shy about his goals. Even before last season began, before he went on to average 19 points and 6.5 assists per game, he said he wanted to win Rookie of the Year. By the Rising Stars Challenge at All-Star Weekend in Houston, he was shooting for an All-Star appearance next year.

That?s just how Lillard operates. He puts his goals in front of him like the rest of us might carry a grocery list.

"Just like he said all of the time last year he wanted to be Rookie of the Year, eventually an All-Star, eventually an Olympian," Jazz player development assistant Johnnie Bryant said. "Now he just wants to prove he should continue to be in that conversation."

Bryant and Lillard are both from Oakland, and Bryant, then a personal skills coach, helped train Lillard before both moved on to the NBA before last season.

Both Bryant and Young struggled to say what has changed most for Lillard in the last year. Bryant says, "If anything, he?s hungrier to continue to prove that last year wasn?t a fluke."

Young acknowledged, though, that as a rookie Lillard "probably woke up in the morning and was like, ?Damn I?m really here.? "

That no doubt extends to Team USA, where he was among 28 players, including Jazz forwards Gordon Hayward and Derrick Favors, trying to shoehorn his way onto a squad already loaded with young guards.

"I wanted it when I watched the Olympics," Lillard said. "That was something I wanted. Obviously, I wanted to make it to the league first. Now that we?re here, it?s just actually real and you realize what you?re working toward and you realize how bad you want it."

To alleviate the logjam at point guard, Team USA coach Mike Krzyzewski had point guards playing off the ball, something Lillard grew comfortable with both in AAU and college.

Still, by the time the FIBA World Cup rolls around next summer, Lillard could be the odd man out behind players such as Russell Westbrook, Stephen Curry and Kyrie Irving. There were eight points guards in last week?s minicamp.

"He felt like he had a good week down there," Young said, then adding, "If he felt like he had a good week, then it was a very good week. He don?t give himself enough credit sometimes."

Which is something he?s used to overcoming.

LOS ANGELES (AP) ? Beauty is in the eye of the Google Glass wearer.

At least that?s what the Internet search giant hopes a handful of young filmmakers will discover. Google is enlisting film students from five colleges to help it explore how its wearable computing device can be used to make movies.

The $1,500 Google Glass headset is already being used by 10,000 so-called explorers. The device resembles a pair of glasses and allows users to take pictures, shoot video, search the Internet, compose email and check schedules.

As part of its experiment, Google will lend each school three pairs of Google Glass.

The participating schools are American Film Institute, California Institute of the Arts, Rhode Island School of Design, University of California, Los Angeles, and University of Southern California.

  • Age: According to data from the Pew Research Center, the age demographic with the largest social media usage rate is 18 to 29-year-olds (83%), followed by 30 to 49 year olds (73%). Not surprisingly, this age stratification has stayed constant since 2005, with the younger subset being the most frequent social media users.

LinkedIn is the place to advertise if you?re offering B2B or employment services and products. With its very specific demographic (professionals and job seekers), LinkedIn allows you to target business professionals in specific industries. Right now, the minimum budget is $10 a day, which could be well worth it if your audience is mostly found on LinkedIn.

At the end of the day, experience is a great indicator for future success. If you?re still unsure about which social PPC platform is right for your business, the best thing to do is test. Run test campaigns on the platforms you feel would best suit your needs, and see which ones you perform well on. Then, optimize those campaigns so that they perform even better. Inspired by Rani of Jhansi, women will fight to liberate India from Congress: Sushma Swaraj

Drawing inspiration from Rani Lakshmi Bai, the fiery Queen of Jhansi, who was the epitome of courage and bravery in the 19th century, senior Bharatiya Janata Party (BJP) leader Sushma Swaraj on Monday said women will fight to liberate India from the Congress Party.

?Rani of Jhansi fought to liberate India from British. Today, we women will fight to liberate India from the Congress,? she said, while addressing the BJP Mahila Karyakarta Sammelan here.

?We couldn?t become a part of freedom struggle, born after 1947. Now, we will be a part of freedom from Congress battle,? she added.

Highlighting the rise in cases of crime and atrocities against women and the girl child, Swaraj said both women and girls in this country are not safe in their houses as well as outside.

?Indian women are in politics, they have reached the space. They have achieved so much, but it?s a shame that women are not safe in India,? she said.

Asserting that the national mood is in favour of the BJP, Swaraj also used the occasion to lure the women voters of the country.

?We have a four point programme for women when we come to power. It?s our declaration and mission.

The senior BJP leader also hinted at early polls.

?Mission 2014 can also be Mission 2013. The situation in which the nation is I don?t think the government can survive,? Swaraj said.

?In the upcoming assembly elections, we have to snatch states from the Congress and defend our states. This is our aim,? she added, while spelling out the BJP?s strategy for the upcoming state assembly polls and general elections.

This laptop has lasted me ages, bearing in mind it is used all the time by everyone in my household (laptops usually last about a year here and i have had this for over 3 years).
It is working as it did when i first bought it and it is also quite hard wearing - it has been dropped several times and it has came out with just a couple of scratches.

The performance is excellent - it is very fast, it has great image quality, a decent-sized hard drive and keeps up with the demands of my gaming. At the same time it is very quiet and has a good battery life. it also does not heat up due to its good fan (which is a lot to expect from laptops these days).

It is also a very nice looking laptop - it is a lovely colour with a unique style.

It is quite light so easy to carry around with you, I am always on the go with this laptop.

Daniel Loeb Comments on Sony Corporation

Equity Position: Sony Corporation (SNE)

Third Point acquired a significant stake in Sony Corporation ("Sony") earlier this year, and in May, we unveiled a proposal to increase value by partially listing Sony's Entertainment ("Entertainment") business in the U.S. Our investment thesis is that Sony ? composed of Electronics, Finance, and Entertainment ? is not well understood by investors and is therefore significantly undervalued. Sony's Entertainment division has leading franchises in movie and television production and distribution via Columbia Pictures and Sony Pictures Television, and is one of the top recorded music and publishing companies in the world. Sony also has coveted global cable network assets, including a strong position in the fast-growing Indian market. Electronics is best known for its struggling televisions and VAIO computers but its true value lies in its strong semiconductor and video game console divisions, and its resurgent smartphone business. At the time we made our initial investment, we believed that at our purchase price we were acquiring Entertainment at an attractive value while receiving Electronics nearly for free, giving us a substantial margin of safety.

In addition to its appealing valuation, we believed Sony would benefit from the economic tailwinds created by the First and Second Arrows of Prime Minister Shinzo Abe's economic plan, i.e., a weaker currency and fiscal stimulus would immediately benefit Sony's margins and drive earnings per share. But it was not until we became familiar with Abe's Third Arrow that we became confident Sony was an ideal candidate to benefit from the type of structural reform recommended by his administration. Following recent victories in the Upper House, Premier Abe is now well-positioned to begin enacting his much-anticipated reforms to modernize Japan's economy and corporations. Like the rest of the world, we are eagerly awaiting these changes, which should benefit Japanese companies like Sony.

Finally, the Sony management team installed last April seems to have broken a long string of challenged leadership and has started to make some difficult decisions in the Electronics business by reducing overhead and cutting the number of products offered. Highlyregarded CEO Kazuo Hirai deserves plaudits for the green shoots increasingly visible in Electronics. Sony's Xperia Z smartphone is a hit, and new product momentum has built meaningfully over the last few months while competitors have been losing ground. Sony is introducing an array of new Xperia models, including a large screen "phablet" device, the Xperia Z Ultra, and new Xperia C and SP devices for China Unicom and China Mobile. The launch of Sony's refreshed Xperia line has been a success in Japan, where Sony has overtaken Apple as#1 in smartphone market share, and in Europe, where Sony has risen to #3 in smartphone share. The upcoming launch of the Honami smartphone and other products in China and the U.S. should offer further opportunities for Sony to gain share in smartphones.

Strong momentum in the smartphone business has been accompanied by a perfectly executed introduction of the PlayStation 4 ("PS4") platform. The PS4 is set to gain share versus its competitors ? the Wii and Xbox ? with better hardware performance, new title breadth, and attractive launch pricing. Sony's consumer-friendly approach also stands to benefit investors with better initial hardware margins than PlayStation 3, increased market share and the growth, revenue and profit contributions ofthe PlayStation Network. The visible improvement in Sony's new products has caused us to rethink our approach to valuing Electronics. The Game and Mobile Products divisions are now poised to join the Devices business as meaningful profit contributors, while the Television business is becoming only a marginal drag.

Putting these encouraging gains into perspective, they are modest in light of the longerterm challenges facing Sony and the Japanese electronics industry. Drastic ? rather than incremental ? action is required. Third Point's proposal to partially list Entertainment should not only increase overall profitability but also provide capital to accelerate restructuring at Electronics, against a backdrop of increasingly fierce global competition. Turning to another challenge: unlike Electronics, Entertainment remains poorly managed, with a famously bloated corporate structure, generous perk packages, high salaries for underperforming senior executives, and marketing budgets that do not seem to be in line with any sense of return on capital invested. We were surprised that after Entertainment's highly-touted big budget summer film releases ? After Earth and White House Down ? bombed spectacularly at the box office, CEO Hirai, speaking at the Allen & Co. Sun Valley conference a few weeks ago, brushed off these failures, saying:

"I don't worry about the Entertainment business, it's doing just fine"

We find it perplexing that Mr. Hirai does not worry about a division that has just released 2013's versions of Waterworld and Ishtar back-to-back, instead giving free passes to Sony Pictures Entertainment Co-CEO's Michael Lynton and Amy Pascal, the executives responsible for these debacles. Unfortunately, Mr. Hirai's remark is consistent with accounts we have heard repeatedly from key industry players and others: under Mr. Lynton and Ms. Pascal's leadership, Entertainment's culture is characterized by a complete lack of accountability and poor financial controls. To us, these latest blunders are prima facie evidence of our thesis that Entertainment's U.S.-based business is being ineffectively overseen and needs its own governance structure led by a board whose job it will be to worry about such troubling results.

We are also surprised that Sony's CEO does not worry that Entertainment continues to generate profitability levels far below those of its competitors. Based on publicly-available peer data as of March 31, 2013, Entertainment has trailing twelve month EBITDA margins that are 700 basis points below peers in the Pictures division and 380 basis points below peers in the Music division, despite the fact that each is an industry leader in revenue terms. If Entertainment achieved peer margins, EBITDA could increase nearly $800 million to just over $2.0 billion.

Entertainment's poor relative performance has been a chronic phenomenon extending back to the famously profligate Guber-Peters regime, suggesting the current configuration of these businesses ? far from offering synergies to shareholders ? is in fact undermining Sony's value potential. Keeping Entertainment underexposed, undervalued and underperforming is not a strategy for success. Sony's investors today would be hardpressed to explain the composition of Entertainment or the key value drivers at work. While management goes to great lengths to explain the strategy for Electronics, it treats Entertainmentlike its "red-headed stepchild", addressing itin only three slides in a twentysix slide analyst day presentation made just a week after Third Point announced its proposal. At a moment when Entertainment was of paramount interest to investors, management barely addressed its significance, business strategy or profitability expectations. Given Entertainment's perpetual underperformance, perhaps Sony's reluctance to discuss it candidly stems from (understandable) embarrassment.

From a creative point of view, we are concerned about Entertainment's 2014 and 2015 slate, which lacks lucrative "tent pole" franchises. Anecdotally, we understand that its development pipeline is bleak, despite overspending on numerous projects. We are also disappointed to see that Sony's television business lacks new material and instead relies on old Merv Griffin Productions workhorses like Jeopardy and Wheel of Fortune. Entertainment has no hit network television shows, only one major syndicated network show? the Dr. Oz Show, and has missed the market for unscripted television.

Meanwhile, our research continues to reveal Entertainment's hidden value. We believe the Pictures unit profitability is anchored in higher margin (and higher multiple) international cable networks and television production, with the film business offering negligible profitability. This makes apples-to-apples comparisons with peer film studios (which lack the benefit of cable networks in those segments) even more unflattering. Nevertheless, we believe the film unit possesses considerable library cash flow value, currently masked by poor new production profitability, as well as significant asset value in its Culver City lot. Beyond the hidden value in the film business, we see meaningful value in the Music division, particularly in VEVO and GraceNote.

Absent a major improvement in transparency and accountability, Entertainment's fortunes are unlikely to change and Sony's full potential will remain unrealized. We are continuing to study Entertainment's businesses, uncovering opportunities for improvement in strategy, culture and operations that bolster our view that it would benefit significantly from our proposal. The suggestion that the status quo of opacity, underperformance and under-management is superior to transparency, management accountability and distinct leadership seems to be based on the misguided notion that the status quo strategy has worked over the last two decades. By contrast, our proposal for a public listing of Entertainment provides investors with a compelling opportunity ? offering focused leadership, direct exposure to high-value international cable networks, significant margin improvement head-room, structural catalysts, hidden asset values and capital return. The status quo offers Sony and its shareholders only more of the same unfulfilled potential.

While CEO Hirai focuses on Electronics, Entertainment is in desperate need of proper supervision. We believe Sony's Board, which we understand continues to consider our suggestions, has plenty of reasons to worry about Entertainment and should enact our partial listing proposal quickly. A resurgent Electronics combined with a well-managed, publicly-listed Entertainment business would make for a stronger Sony and offer tremendous value for shareholders.

Global stock markets eke out modest gains

BANGKOK (AP) ? Global stock markets eked out modest gains as traders refrained from big moves ahead of a meeting of the U.S. central bank that starts later Tuesday.

The Federal Reserve is not likely to announce any policy changes at the conclusion of its two-day meeting, but markets will be on the lookout for hints of an expiry date for the Fed's massive stimulus program.

"Apparently investors are in no mood to place any large bets ahead of the conclusion of the ... meeting on Wednesday but prefer to stay on the sidelines," Anthony Lam of Credit Agricole CIB in Hong Kong said in a market commentary. "As such markets will likely trade in relatively tight ranges for the day."

In early European trading, Britain's FTSE 100 rose 0.5 percent to 6,593.87. Germany's DAX gained 0.8 percent to 8,321.62 and France's CAC-40 advanced 0.5 percent to 3,987.99.

Wall Street also appeared headed for a session of gains, with Dow Jones industrial futures rising 0.2 percent to 15,515 while S&P 500 futures gained 0.2 percent to 1,686.10.

The Fed is currently buying $85 billion in Treasury and mortgage bonds a month in a move that has kept long-term rates near record lows and supported economic recovery. The program has been a boost to stock markets, since low interest rates make equities and commodities a more attractive investment.

Economic data this week could go a long way to determining when the central bank begins to reduce its monetary stimulus. Many in the markets think the Fed could start paring back its stimulus program as early as September.

Japan's benchmark index recovered some of the territory lost during Monday's plunge. The Nikkei 225 index jumped 1.5 percent to close at 13,869.82 despite a drop in industrial output for June. The Economy Ministry said manufacturing slipped 3.3 percent from the month before in June and was 4.8 percent lower than a year before.

While the data underscored the fragility of Japan's economic recovery, it also could provide further argument in favor of the aggressive steps taken by Prime Minister Shinzo Abe to rejuvenate the moribund economy, analysts said. His "Abenomics" policies employ aggressive monetary easing to fight deflation and higher government spending to jump-start an economy stuck in neutral for decades.

"It's probably not a bad thing that industrial production fell. It gives more justification for Abenomics," said Evan Lucas, market strategist at IG in Melbourne, Australia.

Elsewhere in Asia, South Korea's Kospi advanced 0.9 percent to 1,917.05. Hong Kong's Hang Seng added 0.5 percent to 21,953.96. Markets in Taiwan, Thailand and Indonesia also rose. Australia's S&P/ASX 200 was little changed. Mainland Chinese shares were mixed.

Benchmark crude for August delivery was down 56 cents to $103.99 per barrel in electronic trading on the New York Mercantile Exchange. The near-month contract for the benchmark grade fell 15 cents to close at $104.55 a barrel on the Nymex on Monday.

In currencies, the euro rose to $1.3275 from $1.3261 late Monday. The dollar rose to 98.16 yen from 97.90 yen.

Hunter Mahan Withdraws From Golf Tournament He Was Winning to Attend Daughter's Birth

Hunter MahanGolfer Hunter Mahan definitely has his priorities in perspective. He was playing yesterday in the RBC Canadian Open, and was in the lead. He was at 13 under after 36 holes, if that means anything to you, but it didn't mean as much to him as attending the birth of his first child, a daughter.?

His wife, Kandi, wasn't due for another month, but as we know, babies don't always come right on schedule. In the middle of the tournament his agent got a call? -- she was in labor. Without hesitation, Hunter withdrew from the tournament, which carries a $1million prize for the winner, and headed straight to the hospital in Dallas where his wife was preparing to give birth.

In a statement Mahan said:

I received exciting news a short time ago that my wife Kandi has gone into labor with our first child. Kandi and I are thrilled about the addition to the Mahan family and we look forward to returning to the RBC Canadian Open in the coming years.

Fortunately, he made it in time. Today he tweeted news of his daughter's arrival:

What a whirlwind of a day, but I'm happy to announce the birth of my daughter Zoe Olivia Mahan born at 3:26 am. Thanks for all the support!

He went on to say that mom and baby are "doing great" and thanked his sponsors who "appreciate what's important in life." What a great dad!?

If I was in his wife's position ... I don't know. That's a lot of money he was awfully close to winning -- $1,008,000, to be exact. I might have been tempted tell him to stay and play. Maybe she could have Skyped him in for the birth? In all seriousness though, I have great admiration for them for choosing to put their baby first. There will be plenty of other golf tournaments, but this was truly a once-in-a-lifetime opportunity.? He's definitely a winner in our books.
